Chapter & Crumb is the online service described in these Terms of Service. Unless otherwise stated in a specific product flow, feature, or commercial agreement, references to "Chapter & Crumb," "we," "our," and "us" refer to Bahala LLC, the operator of the Chapter & Crumb service.

Bahala LLC should be identified consistently across these terms, the privacy policy, payment flows, copyright notices, and any applicable business or regulatory filings unless a different operator is expressly disclosed for a specific feature or transaction.

Users are responsible for maintaining the confidentiality of their login credentials and for activity that occurs through their accounts. You may suspend or remove access when needed to protect the service or other users.

Accounts must use accurate information, and users must comply with any age or eligibility requirements that apply in the markets where the app is offered.

Chapter & Crumb is not directed to children under 13, and children under 13 may not create or use accounts. If you are under the age of majority in your jurisdiction, you may use the service only with the involvement and consent of a parent or legal guardian.

By using the service, you represent that you satisfy these eligibility requirements and that any registration information you submit is accurate and current.

You retain ownership of the cookbook, recipe, profile, and image content you submit, but you grant Chapter & Crumb a limited, non-exclusive, worldwide, royalty-free license to host, reproduce, adapt, process, display, distribute, and share that content only as needed to operate, improve, secure, and provide the service according to your visibility and collaboration settings.

You are responsible for making sure your content does not infringe third-party rights and does not violate applicable law, platform rules, or the product’s content standards. This license ends when your content or account is deleted, except to the extent content has already been shared with others, appears in backups, or must be retained for legal, security, fraud-prevention, or enforcement purposes.

Users may not upload unlawful, infringing, abusive, deceptive, or harmful material, attempt to bypass security, interfere with the service, or misuse another person’s account or personal data.

The service may remove content, limit sharing, revoke access, or take other enforcement action when these rules are violated or when moderation or safety systems detect a risk.

Users may submit only content they own or are authorized to use. Chapter & Crumb may remove or disable access to content that is alleged to infringe copyright or other intellectual-property rights, may notify the affected user, and may investigate related account activity. We also accommodate standard technical measures to the extent required by applicable law.

Accounts that are the subject of repeated valid copyright complaints, repeated obvious infringement, or repeated violations of the service’s intellectual-property rules may have content removed and may be suspended or terminated. A notice should include the claimant’s physical or electronic signature, identification of the copyrighted work claimed to have been infringed, identification of the allegedly infringing material and its location, the claimant’s contact information, a statement of good-faith belief that the use is not authorized, and a statement under penalty of perjury that the notice is accurate and that the claimant is authorized to act.

If your content is removed or disabled in response to a copyright complaint and you believe the action was taken in error or as a result of misidentification, you may submit a counter-notice. Counter-notices must include your physical or electronic signature, identification of the material that was removed or disabled and the location where it appeared before removal, your name, address, and telephone number, a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, and your consent to the jurisdiction of the applicable federal court.

By submitting a counter-notice, you represent that the information you provide is accurate. We may forward counter-notices to the original claimant, and if the claimant does not notify us within the applicable statutory period, including the 10 to 14 business day period contemplated by applicable law, that it has filed an action seeking a court order, we may restore the content as permitted by applicable law.

Chapter & Crumb may suspend, restrict, or terminate access to the service, remove content, or disable accounts at any time if we reasonably believe a user has violated these terms, created legal risk, interfered with the service, harmed other users, or engaged in fraud, abuse, or other harmful conduct.

Users may stop using the service at any time. Provisions that by their nature should survive termination, including provisions concerning ownership, licenses, intellectual property, disclaimers, limitations of liability, indemnity, dispute resolution, and enforcement, will survive.

We may update these Terms of Service from time to time to reflect product changes, legal requirements, or risk management needs. When we make material changes, we may provide notice through the service, by email, or by other reasonable means.

Unless a different effective date is stated, updated terms become effective when posted. By continuing to use the service after the effective date, you agree to the revised terms.

Chapter & Crumb may contain user-submitted or third-party recipe information, ingredient lists, preparation steps, timing estimates, serving suggestions, allergen references, or nutrition-related statements that may be incomplete, inaccurate, or unsuitable for your circumstances. We do not independently verify all recipe content.

You are solely responsible for evaluating ingredients, allergens, dietary suitability, cooking temperatures, storage, sanitation, and other food-safety considerations before preparing or consuming any recipe. Always use your own judgment and, where appropriate, consult qualified professionals.

Chapter & Crumb does not endorse, guarantee, or verify user-submitted recipes, images, comments, ratings, nutritional claims, safety statements, or other user content. Views expressed by users are their own and do not necessarily reflect the views of Chapter & Crumb.

We may review, moderate, remove, or limit content, but we are not obligated to pre-screen all material and do not guarantee the accuracy, legality, quality, safety, or reliability of any user content.

Users are responsible for claims arising from the content they upload, publish, share, or submit through the service, including claims that the content infringes another party’s copyright, trademark, privacy, or other rights.

To the fullest extent permitted by applicable law, users agree to defend, indemnify, and hold harmless Chapter & Crumb and its operators, affiliates, and service providers from losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to their content, their use of the service, or their violation of these terms or applicable law.

To the fullest extent permitted by applicable law, these Terms of Service and any dispute arising out of or relating to the service will be governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

To the fullest extent permitted by applicable law, the state and federal courts located in Colorado will have exclusive jurisdiction over disputes arising out of or relating to these terms or the service, and you consent to personal jurisdiction and venue in those courts.

These terms constitute the entire agreement between you and Chapter & Crumb regarding the service and supersede prior or contemporaneous understandings relating to the service. If any provision of these terms is found unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these terms will not be deemed a waiver of that provision or any other provision. You may not assign or transfer these terms without our prior written consent, and we may assign these terms in connection with a merger, acquisition, reorganization, or sale of assets.

Chapter & Crumb is provided on an as-is and as-available basis. To the fullest extent permitted by applicable law, Chapter & Crumb disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or completely accurate.

To the fullest extent permitted by applicable law, Chapter & Crumb will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to the service. To the fullest extent permitted by applicable law, the total liability of Chapter & Crumb for claims arising out of or relating to the service will not exceed the greater of one hundred U.S. dollars (USD $100) or the amount you paid to Chapter & Crumb, if any, in the twelve months preceding the event giving rise to the claim.
